  2. firstly, the offence is considered too serious Who is eligible for diversion? Certain types of offending are considered too serious to be eligible for diversion. What is serious is generally determined on the merits of each case. Different types of offences have different aggravating and mitigating factors about them that might make them ineligible for diversion. For example, previous traffic offending and/or current demerits might prevent an offender from receiving diversion for a careless driving offence. Alternatively a clean driving record would greatly improve the chance of getting diversion. Some categories of offences are serious enough in nature to generally be considered not appropriate for diversion, including: burglary or dishonesty offences (in most circumstances) violent offences including family violence offences (in most circumstances) sexual offences or offences with sexual overtones serious drug offences traffic offences which carry a mandatory minimum disqualification offences for breaching a court order

  7. funny how a thread o the topic of breaching court suppression orders quickly morphed into a free-for-all on Covid and politics/ i have some admiration for P4P challenging a pathetically anachronistic law; however, I doubt his motivation for doing so is anything other than narcissistic. He has too much 'form' to take the moral high ground over anything. Still, the decision will be interesting, as Gruff notes. Ca't see the learned judge handing out a Diversions sentence over such a serious matter - would set a dangerous precedent. A stiff fine and/or a month or two in the slammer, more like.
  8. I seem to recall the date 27 August as looming large for sentencing of a convicted felon who breached court suppression orders. I am wondering what RC punters think the learned judge will do to discipline the rebellious rapscallion. we already know the wampant wascal hisself will seek a 'discharge without conviction' for his naughtiness. Will he be on the trail to jail with no bail? And what is he hisself going to do to maximise the enormous publicity opportunities concomitant with the gravity of the offence? Such dreadful timing, with another major court case (in the Mainland) wrapping up in the very same week! Shocking luck.

  15. too late ow to try and address the issue of that god-awful 'grandstand' better to just refer to it as a stand cos it sure aint grand and only just standing. Avondale administrators have had literally decades to tear it down and build something more worthy for the 21st century.. A Strathayr at Ellerslie makes sense to me. What makes no sense at all is maintaining three race tracks and related facilities within a 50km radius for a population base of 1.5m people, 95% of whom couldn't give a rats arse about horse racing. Adapt or die.

  25. RITA was needing a bail out regardless of Covid19. In fact considering RITA had to pay no stakes I would have a guess that RITA's cashflow held up not to bad during April. So...where are the figures of Income/Expenditure since RITA took over running the show? Surely the Half-Yearly Report covering Aug 2019 -Jan 2020 (pre-Covid) would shine some light on this, but there is no sign of this Report, already two months overdue
