No that's completely different; my whanau own the water when it is clean, calm, contained in the lake or river, and most importantly, when the Taniwha is not angry - those floods and the damage caused is completely out of scope. 'Act of god' is the correct terminology.

It's interesting isn't it that in each of the three cases you mentioned the lawyers pointed the finger at someone else to create the 'doubt' in the jurors minds. Now we find that the mother, who they tried to point the finger at, couldn't have done it. The Scott Guy business will now go to the coroner as well, I think.

I agree with your last point. However, it's hard to change the structure. At one point it was suggested that there be three options for the jury to consider: Guilty; Not guilty or Not Proven. The problem is, unless it's clearcut the jury would avoid a guilty / not guilty answer. 'Not proven', would also allow a retrial based on the discovery of new evidence. Anyway, too late for McDonald, but I still think something sinister awaits him with the other charges.
