The state’s premier jockey Jamie Kah is among four riders sensationally stood down by Racing Victoria late on Thursday night in relation to a rogue Mornington house party on Wednesday night.

Group 1 star Ben Melham, Ethan Brown and talented apprentice Celine Gaudray, along with Kah, cannot ride for the next 14 days after attending the Airbnb past the 9pm greater Melbourne curfew.

The jockeys, who defied the State Government “stay at home directions”, were at the short-stay rental with two other non-licensed people.

Stewards have launched an inquiry into the alleged illegal gathering, which was in breach of not only current racing regulations, but also and more importantly the State Government orders.

RV chief medical officer Gary Zimmerman rubber-stamped the 14-day stand down on Thursday night, which results in Kah and Melham losing the rides on Group 1 Memsie Stakes favourite Behemoth and Beau Rossa respectively.

Yes and many more have been through the system in Australia.

If you follow the discussions online in Australia, many are asking for these situations to be put on hold until there's clarity.

As a matter of interest, how do they test to identify what strain  it is from a virus that has never ever been isolated in a Laboratory? as is required Laws< including that of Public Health Acts>

I bet no other jockey tries it on and if they did give them 6 months , 3 for the offence and 3 for stupidity. In the interim , racing will carry on in Victoria despite the stupidity of the named Jockeys. Would the relevant govt authorities let them carry on if there was a next time.?

What exactly do you think they’re guilty of to warrant such a penalty ?

There are no Police charges….just an instant fine …..

It reads rather like an act of revenge initiated by “an ex”.

Am I missing something ?

In all reasonability, these perpetrators should appeal. First offence and no harm done, it would seem a more reasonable outcome to stand them down for 14 days and expect two clear tests.

Did the motor vehicle department of Victoria remove their drivers license for three months?

Were they banned from the supermarkets for three months?

Could any other business in Australia or NZ stand down an employee for three months, on no pay, for a transgression NOT at the workplace? 

David Clark would be quaking reading this given his breach of the law.. he receives ("earned" didn't seem a correct use of the word) 200k a year? So he would have dropped 50k. He lost nothing. There are a lot more examples of highly placed people not abiding the LD rules.

RV overreacted. Simple.

Racing Victoria (RV) Stewards have today concluded an inquiry into the conduct of licensed jockeys Ethan Brown, Jamie Kah and Ben Melham and apprentice jockey Celine Gaudray upon receipt of information of possible breaches of COVID-19 protocols.

The Stewards yesterday charged Ethan Brown, Celine Gaudray, Jamie Kah and Ben Melham with breaching AR 232(b) which reads as follows:

AR 232 Failure to observe processes and directions of PRAs or Stewards

(b) fail or refuse to comply with an order, direction or requirement of the Stewards or an official

The particulars of the charge are summarised as follows:

  • On 25 August 2021, Jamie Kah, Ethan Brown, Ben Melham and Celine Gaudray were present at an “Airbnb” in Mornington after 9pm with two other non-licensed individuals.
     
  • This conduct is in breach of the current State Government Regulations (namely the Stay at Home Directions) which prohibit private gatherings for persons not otherwise living with one another. The conduct is also in breach of the imposed curfew for Metropolitan Melbourne.
     
  • Racing Victoria’s COVID Protocols state that any failure to comply with State Government Regulations will be deemed to be a failure or refusal to comply with an order, direction, or requirement of the Stewards or an official.

The Stewards continued their inquiry this morning with all four jockeys pleading guilty to their respective charges.

Stewards heard submissions on penalty and after doing so took into consideration their guilty pleas, each of the riders’ personal circumstances, that this was their first offence of this nature, that any suspension this time of year includes missing feature race meetings, and that the individuals expressed remorse.

The Stewards also took into consideration the serious nature of the offending, the potential severe ramifications that could flow from a breach of Racing Victoria’s COVID-19 Protocols, and that the penalty must be sufficient enough to deter others from breaching the COVID-19 Protocols. The penalty must also be seen to publicly address the seriousness of the offending and make clear that compliance with the COVID-19 Protocols is non-negotiable.

Taking into account the above considerations, the Stewards have determined that all four jockeys will have their licence to ride in races suspended for a period of three months.

The suspension begins at midnight on 26 August 2021 and will expire at midnight on 25 November 2021.

That statement - which is the summary of facts -  alone should probably condemn them to a hanging!

What happened to the NON licensed individuals? that committed the same crime??

Were they fined the equivalent $$ loss the other have endured??

It is a reasonably good fine for every Australian who breeches the LD rules, in NZ it's a slap on the wrist with a wet bus ticket, if you are a jockey, they destroy your life. Three months is too tough 

May the first man throw a stone..

You clearly have a reading deficiency. The judgement and Kahs tweet says it all.

They potentially jeopardised the  States ability to carry out racing whilst the state is under lock down. If that's what you want your not the full quid or from NSW or both

The well reported actions of Rugby League players in Australia six nights a week is cause for covid restriction concern - even RL players have one night at home - yet they get away with 14 days and two tests. And a badge of honour in the newspaper.

The punishments to RL players who transgress are sanctioned by RLNSW, who's boss is Racing NSW boss.. a prescient therefore already set in NSW, you would have to assume.. it's a pity for these guys the boss of the AFL, who have also had several "brain fade" covid antics, by players, is not the boss of RV... 

I have never said what they did was right, simply that the punishment does not fit the crime.

You are correct, however you simply cannot move the prescient of 14 days and two clear tests to a new high of $5000 fine, 12 weeks off work and a silent fine of a few hundred thousand. That's a bit naughty by any legal standard.

Can't agree with you Phillipe,

Their actions potentially put many thousands of jobs at risk if racing nationwide in Australia was to be closed down.

They knew the rules and openly flouted. No sympathy within racing ranks I am sure.

Surely is a tough suspension but a message had to be sent and it has been as there is simply too much at risk

In NSW from next Friday you can get married with five guests in attendance.

That's a total of seven people from potentially different residences all getting together..

I guess it cannot be a couple of jockeys getting married...

Imagine the potential threat to racing..
