Bbecause the convicted killer is to be sentenced tomorrow morning, the Mustelid thought we could all use a 'refresh' on why continued name suppression is likely

New Zealand judges use a particular section of the Criminal Procedure Act to stop the publication of the identifying details for people charged with, convicted or acquitted of, an offence.

A judge has to be satisfied publication would be likely to result in at least one of the following outcomes:

• Cause extreme hardship to the person charged with, or convicted of, or acquitted of the offence, or any person connected with that person.

• Cast suspicion on another person that may cause undue hardship to that person.

• Cause undue hardship to any victim of the offence.

• Create a real risk of prejudice to a fair trial.

While I am aware it is easy enough to find his name.  There are still a lot of people that would not easily find his name .  So with name suppression you could still get a jury that have no awareness of his other crimes.  Which is what you want.

They have another case already.  Once this is done then name will come our and flush out any further ones.  While Grace and her family are victims, other known victims deserve a fair trial too.

A fair trial in that fact that the accused is trialed fairly and the reduce the possibility of mistrial.

I think where this went wrong was Grace should have had name suppression too.

Well, he probably gets legal aid paid for by the govt and many legals may milk the system. You know, advise a “unanimous Guilty” person there’s a chance of getting off on appeal. It’s a lucrative profession. I’m of the firm belief that the law should be changed so that any unanimous guilty verdicts are unable to be appealed - except where “new and impelling” evidence puts serious doubt on the original verdict. JMHO.
