Joubert is penalising McCaw for marginal indiscretions, while he is not penalising other players (from both teams) for the same or very similar actions. Have a look at the final penalty that Austrlia kicked. Awarded against McCaw for not rolling away quick enough. Compare that to Conrad Smith's tackle only seconds before, which went unpenalised. Then look at the number of times many players from both teams fell over rucks, interfering with the halfback clearing the ball, and weren't penalised. Then think back to Joubert penalising McCaw in the final minutes of the Super 15 Final, when he could have (and should have) just as easily have pinged the Warratahs player.
