It looks like the chant ...'Back Weir ....drink Beer' might not be going up for a while as Stewards have asked for another decade to be added to his disqualification.

Racing Victoria stewards have sought an additional ban of at least 10 years for Melbourne Cup-winning trainer Darren Weir over the use of a jigger on three racehorses.

In a penalty hearing in the Victorian Racing Tribunal on Monday morning, Albert Dinelli KC, representing RV stewards, said a severe punishment needs to be handed down to send a strong message to the racing industry and society that Weir's actions were 'abhorrent'.

"Mr Weir did not merely possess the devices, but he was ultimately caught on surveillance footage using, I'll use the word again, such an abhorrent apparatus on three thoroughbred racehorses," Dinelli said.

"Racing's social licence depends on the reality and on the perception that racehorses are not mistreated and that races are untainted by dishonesty, unfairness and contravention of the rules. Conduct like this jeopardises that social licence.

"Animal welfare is at the forefront of modern thinking. It must be treated sternly."

RV stewards also sought no fewer than seven years' ban for Weir's co-accused, former stable employees Jarrod McLean and Tyson Kermond.

Ian Hill KC, representing Weir, said such a penalty would be unfair and that Weir's initial four-year ban for possessing a jigger - which lapsed in February 2023 - as well as the emotional and financial toll the case had taken on his client, already served as a significant deterrent.

Hill also said Weir is 'contrite and remorseful and completely rehabilitated', statements that were echoed in testimonials for Weir, including one from respected former judge Peter Couzens, who said should Weir regain his training licence, he would have no hesitation sending him a horse.

Weir currently operates a large pre-training business at Baringhup which employs 35 people. Hill said if Weir were to again be disqualified, those workers would more than likely be without a job.

"There should be no period of disqualification and certainly no interference with his pre-training or his ambition," Hill said.

Damian Sheales, for McLean and Kermond, questioned how a further lengthy disqualification was a just penalty when referring to precedents such as the case of Paul Preusker, who was banned for four years back in 2007 for jigger use.

"That is persuasive precedent and he got four years for pleading not guilty," Sheales said.

"How can the offending of (Weir, McLean, Kermond) be viewed as more culpable than Preusker?"

Last month, three corruption charges against Weir were dismissed, with the former leading trainer pleading guilty to animal cruelty charges.

The three-person VRT panel will now consider penalties to Weir, McLean and Kermond, but that isn't expected to happen for a number of weeks.

My opinion FWIW is if you treat horses so badly and cruel..then I dont think you deserve the right to train them to make money from doing so...let him keep doing the pre training but he should not get a licence back...as I say just my opinion..I could never have a horse with someone who treated them like a piece of meat.

As big as I am on second chances, I struggle to think that he should have anything to do with horses at all ever. I suppose it comes down to the evidence of his rehabilitation outcomes.

Totally agree, ban him from everything. Shouldn't be allowed near any horse establishment, or even allowed near a race meeting

Agree totally with Turny on this. His astonishing success esp in Group races, will aways be questioned on account of his cruel and illegal approach to training. Two more years sends the wrong message to others tempted  by the riches available if you can produce the winners/secure the wealthy owners.
