And now we move to the next chapter of this sordid affair. Should those arrested but presumed innocent until found guilty be allowed to ply their trade until they have their final day in court. Lawyers apparently on the case already challenging the standowns

For mine It raises more questions than answers and appears to be without precedent in terms of RIU and JCA. Plus ,one has to establish the basis of their employment, sole trader, contractor etc as employment law may be brought into the defenses case.

Amongst those names not driving was Gavin Smith.  Well Smith was obviously just having some type of holiday, and  like some others would have  unfairly come under suspicion.

    - initial charge(s) laid and one option is no plea entered, so further hearing day for this, then set.

    - when appearing again, not guilty is a plea option. so the learned judge listens and accedes to a charge that will be heard by a jury. An estimated date for this case is then established.

The process was streamlined about 5 years ago and goes roughly like this:

No plea is common at first appearance which will result in being remandsed over for 2 or 3 weeks at which time a plea would be expected. If no plea is entered (can't imagine why) a not guilty plea is entered on behalf.

From there the defence and the prosecution jointly file a “Case Management Memorandum” with the court, and the court registrar considers whether this memorandum raises issues that need to go before a judge before the trial.

This Memorandum will tell the court all the details that relate to the case and what the issues will be at the trial.

The Case Management Memorandum must be filed at least five working days before the case review date.

There are certain things the parties should discuss before filing the Memorandum, so that these can be addressed in the Memorandum if necessary.

    Things like:

Whether the accused would like the judge to indicate what sentence you would receive if you pleaded guilty.

Whether the accused would consider pleading guilty to a lesser or different charge.

Whether the parties agree on any of the evidence that’s to be called, which might mean that a witness does not have to come to court or that the trial will be shorter.

Whether the accused objects to any of the evidence the prosecutor wants to call at the trial.

Whether the parties agree on how long the trial will take, and on a date for the trial.

Can't remember, Herald or Stuff , may have been Guerin because it concluded with comment that slings used to be commonplace  here in racing but not so much nowadays. It was an article referring to Beirne arriving back from Bali on Saturday morning and cops I think will be catching up with him at the airport. Auckland?

Reported yesterday that Beirne said he often rang trainers to get the oil on their runners and if he had a good punting result would often give them a sling. Would all be rubbed out in Hong Kong obviously but just "business" here?

He did not say that at all.

Beirne also admits to being a prolific punter who often rings trainers and drivers seeking their opinions on races.

But he says he never pays them for information and has never offered a harness horseperson a car, or even a cheaper deal, as reward for what he is told.

"I can swear that has never happened," said Beirne.

"I can only think of one time recently I have given somebody a sling [financial bonus] and that was one of the staff when a horse I owned won a race, which is no different to tipping a waiter.

"That is just a thank you for your work and has nothing to with the actual race or the outcomes."

The practice of owners "slinging" winning horsepeople, whether they be drivers, trainers, jockeys or stablehands for a job well done used to be a relatively common practice in horse racing but is increasingly rare these days.

If this is right that it took 80 police 18 months to arrive at this is it any wonder they couldn't get a conviction in the Kahui twins murder and must be burdened down with cold cases.I hope I am wrong with the actual number of police working in this.

the police work has been carried out by the National Organised Crimes Group from Wellington

:rcf-rich-1:bit ironic the'' big police raid on stables'' in the Manawatu turned out to be a discussion withe manawatu racing clubs racing manager.was a bit annoying as say only 6 or 7 harness racing trainers here.

Spectacular headlines are the way of the press. Covers a lot of their inept reporting.

Werent there a couple of stablehands charged from All Stars for using drugs around horses earlier this year? Sounds like the rumours of it being rife in the code are actually true.

I seem to remember they are no longer working there.

I think probably a bit late for silence as police have recorded over 600 phone calls apparently

That doesn't matter as its upto a jury to decide.

Anyone who speaks to the police about a criminal matter they are accused off is not only foolish but they are assisting the police to do thier job.

Dexter house has been searched and computer taken.Apparently he will be initially interviewed by USA authoritys

Would he be elligible to plead the fifth at an interview cos in nz he would have the right to silence which is the stance each and every one charged should adopt
